Joseph Donovan discussed "Looming Constitutional Challenges: State Corporate Income Tax Conformity with the International Tax Provisions in the TCJA," at the Council On State Taxation's (COST) 49th Annual Meeting.

The event analyzed the potential constitutional infirmities with state corporate income tax conformity with the international tax provisions in the Tax Cuts and Jobs Act. The speakers discussed issues relating to factor relief (or the absence thereof) and potential discrimination against foreign commerce. The panel also provided a perspective on the different application of constitutional provisions in separate reporting and combining reporting states.
