Our benefits attorneys design and draft the full range of retirement, welfare, fringe benefit, equity compensation and deferred compensation plans. We also prepare related employee communications, assist with all necessary Internal Revenue Service and Department of Labor filings (as applicable) and help ensure compliance with all applicable laws.
We work with domestic and multinational employers to design and implement qualified retirement plans (profit sharing, money purchase pension, defined benefit and 401(k) plans, as well as employee stock ownership plans (ESOPs)), advise on retirement plans for tax-exempt organizations (including 403(b) and 457 arrangements), implement nonqualified deferred compensation arrangements (including the use of rabbi trusts and secular trusts, golden parachutes, top hat and excess benefit plans) and structure welfare and fringe benefit plans (medical, severance pay, life insurance, disability, dependent care and education assistance). Our expertise covers applicable ancillary laws, such as HIPAA's privacy and portability requirements, securities laws (Form S-8 requirement, for example) and employment tax reporting and withholding.
Our lawyers frequently represent employers in IRS and DOL audits, and have extensive practical experience in helping employers utilize available correction programs issued by both agencies to correct a multitude of plan problems.
