Jeffrey M. Karp is the co-leader of the firm’s Climate-Related Business & Technology Group, which brings together practitioners from across the firm’s legal disciplines to advise clients regarding legal, regulatory and policy issues involved in conducting business in a carbon-constrained world. The Group further seeks to facilitate opportunities for clients to participate in climate-related programs and projects, businesses, and markets worldwide. Mr. Karp also is a partner in the Environmental & Natural Resources Group of our Washington, D.C. office. He advises clients on the full range of climate-related and environmental laws and regulations impacting business operations, projects and transactions. Mr. Karp assists clients in developing renewable energy and carbon emission reduction projects. He has substantial experience regarding the legal, contractual and regulatory issues involved in infrastructure development and construction projects, including seeking the required authorizations and certifications from governmental authorities, and negotiating the necessary agreements and contracts. Mr. Karp also advises clients regarding participation in carbon-trading transactions. Further, he counsels clients on a wide range of regulatory compliance issues under U.S. federal, state and local environmental laws, and regarding greenhouse gas reduction legislative initiatives and regulatory requirements.
Mr. Karp represents clients in government regulatory enforcement matters and in resolving environmental claims arising from transactional agreements. He also represents clients in pollution-related lawsuits involving claims for payment and/or remediation. Mr. Karp has been in private practice since 1990, after serving as a litigator and a Senior Attorney at the United States Department of Justice.

Representative Client Work
- Assisted a Canadian company in negotiating terms for the sale of carbon credits to a U.S. company from a landfill gas emission reduction project
- Advised an Israeli clean-tech company regarding the addition of a carbon component to its waste-to-energy technology, and assisted a project owner of the licensed technology in Mexico in seeking to sell emission reduction credits to an international compliance trader
- Advises renewable energy companies concerning the availability of funds from the American Recovery and Reinvestment Act to further develop their projects
- Advises an insurance carrier in developing new insurance products for the U.S. market pertaining to carbon emission credits and offsets
- Developed a due-diligence plan for a venture capital company and a clean-fuel technology developer for a transaction with an electric utility company
- Assisted a client in performing environmental due diligence for a transaction to site and construct a new power generating facility, and counseled the client regarding the potential impact on the project of future climate-related legislation
- Advised an international consumer products manufacturer regarding the federal and state regulatory requirements governing the marketing of “green” products
- Evaluated “green” product claims of a client’s competitors, and sought action by federal and state regulatory authorities for claims lacking substantiation
- Gained inclusion in Leadership for Energy and Environmental Design (LEED) Green Building Rating System for Existing Buildings credits in the operation and maintenance category for a manufacturer of battery-powered, non-GHG or particulate-emitting outdoor power equipment
- Advised a manufacturer of new energy efficiency and conservation products regarding opportunities to enhance product marketing through existing government incentive and consumer education programs, and regarding legislative and regulatory opportunities to gain marketplace advantage
