EPA’s Release of the First Phase of the Dioxin Reassessment and Reference Dose May Lead to More Stringent Exposure Standards and Legal Challenges

After much delay and despite the widespread concern of commenters, the Environmental Protection Agency (“EPA”) has released its findings regarding the non-cancer risks associated with dioxin, thus splitting the non-cancer and cancer portions of the assessment. This Advisory discusses the non-cancer assessment, which resulted in EPA's establishment of a stringent reference dose, which opens the door to more stringent environmental remediation standards, both when establishing original cleanup levels and when evaluating a site’s progress at its five-year review.
