Federal Trade Commission Orders Company to Cease and Desist from Selling Worthless Environmental Certifications to Green Product Marketers

This Client Advisory addresses a growing concern in the area of "green marketing:" the use of third-party certifications or seals of approval by product marketers to substantiate their green marketing product claims. The Advisory reports on a recent U.S. Federal Trade Commission (FTC) enforcement action against a company charged with selling worthless certifications to green product marketers. The Advisory discusses the FTC's pending revisions to its Environmental Marketing Guides, and highlights the pitfalls of relying on third-party certifications and seals. The Advisory also reminds product marketers that they remain liable for their green marketing claims, and, therefore, cannot rely blindly on third-party certifications or seals to substantiate those claims.
